1. Introduction
Gift & Ship Direct ("the App Extension"), owned and operated by Evergreen Ideation ("we," "us," or "our"), a California company, provides a software tool designed for Shopify merchants ("Vendors"). The App Extension allows a Vendor’s end-customers to purchase items for a recipient without requiring the customer to know the recipient's shipping address.
We are deeply committed to data privacy. This Privacy Policy explains our structural data practices.
2. The Absolute Privacy Wall (No End-User Data Collection)
Our App Extension is built entirely on a zero-retention infrastructure.
- End-User and Recipient Data: At no time does Evergreen Ideation or Gift & Ship Direct collect, view, store, intercept, or manage personal information from end-users or gift recipients (including names, emails, phone numbers, or physical shipping addresses).
- Data Flow: All information entered by end-users or recipients is handled directly and exclusively by the Vendor’s native Shopify ecosystem.
- Data Controller Status: The Vendor using the App Extension acts as the sole Data Controller for any customer or recipient data generated through the tool. We do not act as a data repository.
3. Data We Process (Vendors Only)
The only information visible to us relates directly to the business-to-business transaction with the Shopify Vendor:
- App Download & Usage Visibility: We see when a Vendor downloads, installs, or uninstalls the App Extension via the Shopify Extension Site.
- Usage Fees: We track and process usage frequency metrics strictly for billing and fee collection purposes via Shopify's ecosystem.
- Technical Logs: We do not track user behavior or use third-party analytics (like Google Analytics) on our extension.
4. California Privacy Rights Disclosures (CCPA/CPRA Compliant)
Because we do not collect personal information from consumers, we do not—and cannot—"Sell" or "Share" consumer personal information as defined by California law. If you are a Vendor utilizing our services, any data rights requests (access, deletion, correction) submitted by your customers must be handled by you via your store’s privacy infrastructure.

1. Contractual Agreement
By downloading, installing, or utilizing the Gift & Ship Direct app extension (the "Extension"), you (the "Vendor" or "Merchant") legally agree to these Terms & Conditions. If you do not agree, you must immediately uninstall the Extension from your Shopify store.
2. Nature of Service & License
Evergreen Ideation grants you a non-exclusive, revocable, non-transferable license to download and run the Extension on your active Shopify store. The Extension itself is free to download, with subsequent usage subject to the fee structures outlines on the Shopify Extension Site.
3. Strict Reservation of Rights & Immediate Termination
Evergreen Ideation retains absolute control over the distribution and availability of the Extension.
- Right to Terminate: We reserve the right to suspend, disable, or permanently delete a Vendor's access to the Extension immediately, without prior notice or liability, for any reason whatsoever.
- Reasons for Termination: This includes, but is not limited to, a breach of these Terms, non-payment or failure of Shopify usage fees, actions that harm the brand reputation of Evergreen Ideation, or any attempt to reverse-engineer the Extension.
4. Vendor Legal Obligations & Indemnification
- Data Handling: The Vendor acknowledges that they are entirely responsible for the collection and lawful processing of all recipient shipping addresses generated via the Extension. The Vendor must ensure their own store's privacy policy accurately reflects this data collection.
- Indemnification: The Vendor agrees to defend, indemnify, and hold harmless Evergreen Ideation and its officers from any claims, damages, or liabilities arising from the Vendor's data mishandling, data breaches within their Shopify environment, or violations of privacy laws.
5. Limitation of Liability
The Extension is provided on an "AS IS" and "AS AVAILABLE" basis. Evergreen Ideation makes no warranties that the software will be error-free or uninterrupted. To the maximum extent permitted by California law, Evergreen Ideation shall not be liable for any indirect, incidental, or consequential damages resulting from app performance, downtime, or use.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
